Building a register of intellectual property (IP) based on Media Rights Revolution

Putting IP in order in a companies that produces, licenses or distributes media content

musicians and IP

In media companies engaged in the production or resale of intellectual property objects - be it music, text or audiovisual works, there is one fact - such companies are built around several employees who know everything about their market and about the products being created/sold exclusively. And when such an employee decides to change his place of work, knowledge flows away with him. How to protect yourself from such a situation, and at any time get an answer to the question - what rights does the company have to the media product?

There is also a second, deeper question - sales history, financial conditions, contacts and reports.

MediaRights Revolution helps to answer both questions, but let's start in order

As you know, even the most talented media manager cannot keep all the information in his head.

Therefore, sooner or later, the information moves to the phone and computer. Most often, Excel is used to store working information. Many large companies continue to live by storing data in excel, and claim that it is convenient.

We have tried to highlight the criteria that the register of rights must meet so that employees and owners of the company feel comfortable, and receive the necessary information quickly and without problems.

Information about intellectual property objects (metadata)

  • Title

  • Alternative names

  • Description

  • Manufacturer

  • Copyright holder (large media companies have several legal entities, and now we are talking about the copyright holder of license rights in the system)

  • Country of manufacture

  • Date of production (what do you think, why?)

  • Type of media content (music, audiovisual work, text, etc.)

  • Type (depends on the type: for example, for music it is an album, track, single)

  • Category – (serves for quick sampling - it can be genre, audience, purpose. Can be designated as tags)

  • Participants are also important for the search, and here you need to list everyone who participated in the creation of the work – artists, actors, directors.

After that, when you integrate your information system with other company resources, these fields will be useful to you.

Let's see what an object card looks like in Media Rights Revolution (MR2):

Information about copyright and related rights

If your company is engaged in the production or distribution of music, then it is important for you to store data on copyright and related rights to musical compositions. Thanks to this data, you will be able to calculate payments of royalties and payments for related rights. For the music market, copyrights can be divided into music and text, related rights are divided into the rights of the performer and the rights of the manufacturer. Also, for each type of right, there is the possibility of dividing income between several co-authors and/or producers. By default, (unless the author of the music and the author of the text have agreed otherwise) the income for copyrights is divided in the ratio 50/50. The same thing happens with income for related rights. But there is also a division of income between several co-authors.

What does this mean?

This means that each piece of music must have the following fields:

Copyright

Musicы - % powder

Coauthor 1 - % powder from 100% music powder

Coauthor 2 - % powder from 100% music powder etc.

Text - % powder

Coauthor 1 - % powder from 100% text powder

Coauthor 2 - % powders from 100% powders to text, etc.

Related rights

Performer's rights - % of rights

Co-executor 1 - % of the rights from 100% of the rights to the rights of the performer

Co-executor 2 - % of the rights from 100% of the rights to the rights of the performer, etc.

Manufacturer's rights - % Manufacturer's rights 1 - % of rights from 100% of rights to manufacturer's rights Manufacturer 2 - % of rights from 100% of rights to manufacturer's rights, etc.

Of course, we are now talking only about property rights. There is also the right of authorship, which does not participate in business.

So, in order to conclude license contracts and calculate payments on them, first you need to describe the objects with which license transactions will be made.
